The legal action stems from a Jan. 1 call to the Summit County Sheriff’s ffice that a suicidal female needed assistance as Sachs’ Snyderville Basin residence. According to court documents filed by County Attorney David Brickey Sachs invited deputies into his home where they “detected a strong odor of marijuana” and “observed a marijuana pipe” near the suicidal female who was determined to be a juvenile. Paramedics also responded but the female whose name was not released was unharmed said Summit County Sheriff Dave Edmunds. Deputies sought a warrant after Sachs refused to let them search the house. While conducting a search they turned up 11 ounces of marijuana in the master bedroom. Sachs also was charged with third-degree felony child endangerment by “knowingly or intentionally” allowing a minor to ingest a controlled substance.

The state Court of Appeals’ July ruling upheld the conviction and sentences of Danny Ray Hardesty in Yavapai County for possession of marijuana and possession of drug paraphernalia. Hardesty argued he was entitled to use marijuana under religious freedom protections of the state and federal constitutions. The Court of Appeals acknowledged that courts have ruled that use of peyote for a bona fide religious belief is a defense to prosecution. But the ruling said marijuana use is more pervasive and that the uniform ban on possession and use is a legitimate restriction imposed by government.
