Fayetteville city attorney Kit Williams says city ordinances can be more restrictive than than state laws, but not less restrictive. According to state law, possession of marijuana is illegal and the city officials take an oath to enforce those laws. The mayor has discretion of where the resources go, and police have said their priorities are already focused on more serious crimes. They also say small amounts of marijuana are already considered a low priority and arrests involving the drug stem from another law being broken, like a DWI, or reckless driving, and the pot is found later.
