Cal Supremes to review medical marijuana law

tmpl –>(08-14) 10:24 PDT San Francisco, CA (AP) –The California Supreme Court has agreed to review a lower court decision that found state law improperly limits the amount of medical marijuana a patient can possess. The case will test a 2003 law that shields doctor-approved pot users from arrest for possessing up to eight ounces of dried marijuana or growing six plants. In May, a state appellate panel overturned the conviction of a Los Angeles County patient charged with possessing 12 ounces of pot and seven plants. The panel found the 2003 law conflicted with Proposition 215, a 1996 voter-approved measure that legalized medical marijuana without setting specific limits. Some medical marijuana advocates support the newer law, saying it merely provides guidelines to keep police from making unnecessary arrests.

But it’s what was allegedly sold under the counter that brought some students to the pizza parlour directly across the street from the school. Calgary Police Service searched the business and its owner’s house Wednesday night in relation to an alleged drug trafficking operation based at the pizza store. Police found marijuana, money, a debit machine and 38 student ID cards and believe the drugs were being sold to students and residents.

American Fork police responded to a call reporting a marijuana smell coming from a motor home in an area RV campground. Police found that three adults – ages 18, 19 and 22 – had been smoking pot and sharing it with the 12-year-old whom they were baby-sitting while his mother was out of town. Gregg Ludlow of the American Fork Police Department said the adults had passed the pipe to the child, who smoked it.

Cannabis cultivator to learn his fate

Paul Day, of Peterhouse Crescent, was due to be sentenced at South East Suffolk Magistrates’ Court on Wednesday but legal arguments meant the case was adjourned for another week while issues are resolved. Police found a “sophisticated” growing operation at Day’s house during a raid in February. They discovered outbuildings and two caravans in the back garden that had been modified for the production of cannabis plants. Officers also found a device in the loft which was used to divert electricity to the growing equipment and a small amount of amphetamines.

According to reports, officers allegedly found “numerous marijuana leaves,” Hydrogrow brand soil fertilizer and blocks used to grow plants, 13 smoking pipes with residue and a jar of suspected marijuana. A grinder with more marijuana and another pipe were also reportedly found in the attic and stuffed in a garbage bag on the back deck, respectively. Lavigno was arrested on an outstanding 2007 warrant for failure to appear in court for minor traffic offenses from Lilburn police.

It can be very discouraging,” Shawber said. Property owners where the marijuana plants are found are not usually charged with a crime. “A lot of the harvest we do is usually on property that is not controlled by the person who planted the marijuana. Most of the time, the plants are found in farmer’s fields where they will go in and plant one here and one there, along fence rows. The farmer has no idea that it is being done,” Shawber said.
