Drug tests conducted Nov. 13, 16 and 20 show that Smith has been using marijuana, according to a written notice to the court signed by the caseworker supervising his pretrial release. A test administered last week also indicated marijuana use, Jezic said. Prosecutors have asked that Smith’s bond be revoked in light of the violations. Smith, 25, has been out on bond since November 2006. Jenkins has been charged with possession of crack cocaine, distribution of marijuana, possession with intent to distribute marijuana, possession of a Schedule III narcotic and possession of Ecstasy. Allen has been charged with possession of both crack and powder cocaine. Many of the Le Dain commission’s recommendations were too explosive for politicians of the day to embrace. But judges soon started moderating sentences and began giving offenders absolute discharges for simple possession… But it was its recommendation to decriminalize simple possession of marijuana that caused the greatest sensation. Marijuana opponents want to overturn law

UKIAH – Critics of a ballot measure that decriminalized marijuana for personal use in Mendocino County are seeking an election to overturn the law. The voter initiative that passed in 2000 was intended to allow residents to grow marijuana for their own medical use. Its opponents argue that the law has been abused and led to a surge of marijuana cultivation around the county. County Supervisor Jim Wattenburger, who supports repealing the measure, said marijuana-generated income accounts for up to 75 percent of the county's economy.
