(AP) — A judge ordered a failed 2004 city initiative on medical marijuana returned to the ballot next year because county election officials failed to hand over data from voting machines. Superior Court Judge Winifred Smith also ruled Tuesday that Alameda County officials should pay attorneys’ fees and reimburse a medical marijuana group more than $22,000 for the costs it incurred during a disputed recount shortly after the November 2004 election. Smith ruled that county officials had failed to retrieve backup data from electronic voting machines, logs of activity on the machines and other records as she had specifically ordered. Instead, the county ignored the request and returned the devices to their manufacturer, Diebold Election Systems, after the measure’s advocates had sued the county seeking access to the data, the judge said. “Why the county did so is anybody’s guess,” the judge wrote.

Dukes gets probation for marijuana possession charge

TAMPA - Inactive Rays outfielder Elijah Dukes pleaded no contest in Hillsborough County Court on Thursday to a misdemeanor marijuana possession charge. County Judge John Conrad withheld adjudication in the case and sentenced Dukes, 23, to one year probation and 50 hours of community service, plus drug testing. Dukes was charged with marijuana possession after he was pulled over by Tampa police Jan. A drug-sniffing dog reacted to his car, and authorities said a search revealed a bag with about 2 grams of the drug in a center console. Conrad gave Dukes permission to complete his probation requirements by mail and without meeting with a probation officer. Dukes plans to leave Oct.

Students punished over cannabis

Paramedics were called by the head teacher of St Augustine’s Roman Catholic High School in Billington, Ribble Valley, on Wednesday afternoon. The pupils, who are aged 14 to 16, were taken to the Royal Blackburn Hospital for treatment. One student has been expelled and six have others been suspended. Police are investigating the incident.
