— New Mexico will not grow medical marijuana for seriously ill patients for fear that the federal government could prosecute state workers, but will continue to certify which patients are eligible to possess the drug. The state health department said Wednesday it will not comply with a portion of the new medical marijuana law that requires it to oversee production and distribution of the drug. It will still certify patients as eligible to possess marijuana, protecting them from state prosecution. “The Department of Health will not subject its employees to potential federal prosecution, and therefore will not distribute or produce medical marijuana,” said Dr. Alfredo Vigil, who heads the agency… — New Mexico will not grow medical marijuana for seriously ill patients for fear that the federal government could prosecute state workers, but will continue to certify which patients are eligible to possess the drug. The decision came after state Attorney General Gary King cautioned last week that the agency and its employees could face federal prosecution for implementing the new law, and that his office can’t defend state workers in criminal cases. Marijuana is illegal under federal law.

The marijuana was seized at a home in June in what Geauga County authoritiescalled the largest seizure in the history of the northeast Ohio county — 580 marijuana plants. A27-year-old man was charged in that case. Investigators sent the marijuana to a crime lab and when it came back, drug agentslocked it in a trailer on private property at an undisclosed location. The sophisticated grow operation had an elaborate gravity-fed watering system, and appeared to have been in place for a year or more, Sheriff Frank T. Rogers said Tuesday. The suspects had also set up several living, cooking and bathing locations that were camouflaged with branches to keep them from being seen from the air, he said. The seizure is the latest illegal drug activity in the county.

On July 31, law enforcement officers arrested DeMoura and others associated with the collective at 1275 East F St. Everyone arrested has since made bail, said Stanislaus County Sheriff’s Department spokesman Royjindar Singh. Police searched the collective and confiscated an undisclosed.
