Earlier in the week, the judge dismissed money laundering and tax charges against Rosenthal. Breyer said Friday he wants the government to assess whether it should go forward in light of his ruling. Rosenthal, 62, was convicted on three marijuana-growing felonies in 2003. Breyer sentenced him to just one day in prison, which Rosenthal served, saying the “Guru of Ganja” reasonably believed he was growing the plants on behalf of Oakland officials for a city medical marijuana program. A federal appeals court overturned his conviction last year because of misconduct by a juror who consulted an attorney on how to decide the case. Federal prosecutors indicted Rosenthal again in October over the same marijuana operation, adding four counts of hiding money and five counts of filing false tax returns.

The 400-plant crop, in the Styx River State Forest, nearArmidale, was allegedly uncovered after police arrested two men,aged 32 and 49, at their Armidale homes. About $50,000 worth of cannabis was seized from the two homes,police said. Both men were charged with a string of offences, includingpossession and supply of cannabis. They have been granted conditional bail to appear in ArmidaleLocal Court on April 5.

The marijuana was found in cardboard boxes stuffed into compartments designed to hold medical supplies, detectives said. Detectives said the marijuana had a street value of about $500,000. It was the largest drug bust in the Arkansas town’s history. Investigators said they believe the men picked up the marijuana in California for a Florida destination. The ambulance was registered to a West Columbia, Texas, home under the name Life Line, LLC… Two other men, Robert Abreu and Anthony Aviles, both from Florida, were also taken into custody.
