Deliberations begin in Sawin trial
Berkshire Eagle, The – Berkshire Eagle – Sep 23, 2005
today, when deliberations are set to resume.
Sawin is accused of selling marijuana to undercover Berkshire County Drug Task Force member Felix Aguirre three times during a police probe at the former Taconic parking lot, a popular meeting place for teens and young adults that authorities contended was also a hub for drug activity.
The investigation eventually netted 17 people on drug charges.
The defendant, who faces a minimum mandatory 2-year jail sentence if convicted of a school zone offense, initially went on trial in July.
A mistrial was declared in that case after the jury deadlocked.
During both trials, defense attorney Judith Knight, contended that her then-17-year-old client, an admitted marijuana user, was entrapped by Aguirre, who persistently asked him to buy drugs until the defendant finally broke down and sold some of his personal supply on Advertisement…
Cronin, who, along with Genneri, testified yesterday, admitted to the one sale he is charged with and alleges that he had purchased the marijuana from Sawin that he later sold to Aguirre.
Genneri later testified that he had bought marijuana from Sawin five to seven times in the year before the sting operation.
On some occasions the drugs would be pre-packaged; other times, Sawin would measure out the marijuana using a hand-held scale, Genneri said.
Aguirre previously testified that Sawin also used a scale during the July 6, 2004 transaction.
Sawin said he just sold Aguirre half of his personal supply that day and denied ever using a scale during the deal.
Knight, in her closing, questioned the truthfulness of the three men, all of whom said they hope to have their own 2-year mandatory minimum charges dropped by prosecutors in exchange for their cooperation.
